Terms & conditions for performing the service of brokerage for trading with real estates - buyer

Terminology explanations:
 

real estate company Atrij stanovanjska zadruga z.o.o., Atrij z.o.o. further on
broker a person, who conducts real estate brokerage
client a person who has signed a brokerage contract with Atrij
third person a person who is trying to make contact with a client via
real estate broker
client's close family member a client's spouse or cohabiting partner, living with client
according to rules of marriage and family relations,
their children or adoptees, parents or adopter and people
who are legally responsile to support them
brokerage contract a contract by which Atrij is obliged that their
broker will do the best she can to get a client in touch with a person that will be negotiating to make a contract to purchase a certain real estate; client is obliged to pay a commission to Atrij if a contract is awarded

 

1. Effectivness of general conditions of conducting business

General conditions are integral part of every contract on brokerage that is awarded between client and Atrij z.o.o. If a real estate brokerage contract includes rules which are in opposition to these terms & conditions, the rules of brokerage contract are valid.
 

2. Brokerage services of real estate purchase

On the basis of brokerage contract when buying a real estate a broker on behalf of Atrij z.o.o. for a commission from point 3.1 is obliged to do following services:
 

  • Excepts an order to broke buying of real estate and getting basic information on client, a future buyer
  • Prepares a contract on brokerage for buying a real estate with determination of extent and method of brokerage
  • Makes an agreement on desired typology and location of real estate, size of real estate, expected purchase value of desired real estate, etc. with a client
  • Makes a description of desired real estate for presentation purposes
  • Collects and manages information on possible offers and bidders accordingly to the client's demands
  • Acquires and manages all documentation on ownership from the owner of the potentially purchase suitable real estate (purchase contract, land registry statement, map copy, decision on succession or any other valid legal domain)
  • Acquires and checkes documents in land register concerning encumbrances of real estate (pledges, easement, pre-emptive and any other rights)
  • Determines actual size of real estate (building) by floors and appertaining land
  • Acquires all technical documentation and photographs (building permit, project to attaing building permit, photographies of real estate) from the owner
  • Determines equipement of real estate with electricity, water supply, heating, telphone, cable TV system or satellite anntenna, gas and regulation of surroundings
  • Gathers information on shape and position of the parcel, information on technical and legal regularities or irregularities of the parcel, type of usage, land register class and the size of the land
  • Arranges real estate evaluation if client demands it
  • Accquires all documents on possible servitude or any other encumbrances for the real estate
  • Accquires planning information on the land use category
  • Collects and handles information on financial and other purchase conditions
  • Takes part in discussions and negotiations between the client and the third person
  • Makes an arrangement between a client and the third person about the means of payment for the real estate
  • Arranges all files to write a contract
  • Orders a lawyer with certified proficiecy examination to write a contract
  • Hands over all legal and technical documentation to notary, lawyer and administrative authority
  • Checks the identity and citizenship of client and the third person
  • Fills the RUJP form (National Personnel Administration for Public Income Form) for the tax assessment according to the real estate transaction and gives tax authority a contract
  • Arranges signature legalisation at notary on the purchase contract
  • Notifies water, electricty, etc. manager and supplier about the ownership changes for the real estate which is purchase object
  • Makes material handover with client and the third person
     

2.2 Broker for Atrij z.o.o. within the range of Brokerage for the real estate purchase contract for the additional fee conducts other services specifically defined with the client:
 

  • Extra cost for ‘SPECIAL SERVICE' is 150 E / DAY and includes airport collection, hotel transfer, arrangements for the following days viewing of the properties (other expensis such as hotel, food, drink, etc. are not included)
  • Carries out writting and signing a contract procedure with a lawyer with judicial examination (also purchase contract in a form of notarial record which is a direct executory title)
  • Writes a suggestion to enter an ownership right on real estate if a real estate is alrealy entered in to a land register
  • Assures execution evaluation expert's detailed report
  • Resolves land register state of the real estate if a real estate is not yet entered in to land register or if the seller is not yet entered in the land register as the owner of the real estate
  • Other services specially arranged between broker and client
     

3. Brokerage fee

Brokerage fee of 2 % of purchase value + VAT for the real estate brokerage covers all expenses for services included such as making contact for client, checking the state of real estate, negotiations and arrangement for conducting legal business which is necessery to close a legal contract for certain real estate, especially expences for following services:

  • Signing a brokerage contract for real estate supplies
  • Acquaint client and the third preson with market proportions which are important for price determination of real estate, contents of regulations which are important to close a brokerage contrat for real estate supply, level of tax fees for the customer and prices for notary services
  • Determining legal state of the real estate with acquisition of documents for real estate (land register extract), contacts (if real estate is not yet entered into land register), etc.
  • Written warnings, notices, confimations
  • Sighting real estate after signing brokerage contract for real estate supplies
  • Acquainting client with real estate and making contact with the third person
  • Presence at sighting of real estate ordered by client
  • Acquainting client with legal and actual state of real estate and trustworthingly calling attention to recognised defects
  • Performing telephone communication with clients
  • Participating any negotiations when conducting business


At the request of the client real estate company will conduct other additional services which are based in Terms & conditions for performing the service of brokerage for trading with real estates as follows: ________________________________________________________

Client is obliged to pay real estate company performed service according to the valid price list of real estate company.
 

The amount of fee for brokerage is a result of brokerage contract.
